W A 'C k R E N f k 4ri 'Y 1_ S S f( <br /> RIVERSIDE PUBLIC UTILITIES <br /> a mmM. m, <br /> Board Memorandum <br /> PU B L .I C U I :I: L .I.. .I I E S <br /> BOARD OF PUBLIC UTILITIES DATE: APRIL 2, 2015 <br /> ITEM NO: 12 <br /> SUBJECT: SURPLUS PROPERTY DECLARATION/SALE AND DISPOSITION OF A PORTION <br /> OF ABANDONED RIVERSIDE WATER COMPANY CANAL - KARGER <br /> CORPORATION <br /> ISSUE: <br /> The issue for Board of Public Utilities consideration is approval of the surplus property declaration and <br /> the Purchase and Sale Agreement for the disposition of an abandoned Riverside Water Company Canal <br /> parcel ("Canal"), identified by Assessor Parcel Number 135-280-041, and located along Indiana Avenue, <br /> easterly of Buchanan to Karger Corporation in connection with the recordation of Tract Map No. 34236. <br /> RECOMMENDATIONS: <br /> That the Board of Public Utilities recommend that the City Council approve: <br /> 1. The declaration that 17,165 square feet of abandoned Riverside Water Canal Company parcel <br /> is surplus to its needs; <br /> 2. The Purchase and Sale Agreement for the net fee transfer of 7,115 square feet of the <br /> abandoned Riverside Water Company Canal property to Karger Corporation for$2,900; and <br /> 3. The acceptance of 10,050 square feet of street right of way per recordation of Tract Map No. <br /> 34236. <br /> BACKGROUND: <br /> The City of Riverside Public Utilities Department's (RPU) acquisition of the Riverside Water Company <br /> (RWC) in 1961 included various easements and fee parcels within the City, inclusive of the subject <br /> property. In 1893, prior to the City's acquisition of the RWCC, RWCC granted a public road easement <br /> over one half of the Canal to the City for what is known today as Indiana Avenue, easterly of Buchanan <br /> Street. <br /> The Karger Corporation owns approximately 4.75 acres located along Indiana Avenue at Buchanan <br /> Avenue. In order to divide this property into seven residential lots, Karger filed an application for the <br /> filing of a tract map. On December 12, 2014, the Board of Public Utilities approved modifying the City's <br /> service boundary agreement with Western Municipal Water District in order to allow RPU to provide <br /> water service to this new development. This modification was subsequently approved by the City <br /> Council on January 6, 2015. <br /> The current issue before the Board is the sale of 7,115 square feet of abandoned RWCC property to <br /> Karger (the remaining 10,050 square feet were previously granted to the City as street right of way in <br /> 1893). As currently configured, Karger can only access its development property by crossing over the <br /> abandoned Canal parcel on the north. Staff is proposing the sale and transfer of the entire 17,165 <br /> square feet Canal parcel to Karger. The recordation of the Quitclaim Deed to Karger will be concurrent <br /> with the recordation of tract map, in which 10,050 of street right of way will be dedicated back to the City <br /> (see the attached Tract Map No. 34236). Karger will pay RPU $2,900 for the remaining 7,115 square <br /> foot vacant Canal property. <br />
