The Water <br /> Department Director, Kevin Milligan had just given a presentation to you with <br /> new information on the recent State policy/legislation for additional water <br /> conservation measures coming in the near future. I gave you pertinent <br /> information from legal research that Kevin was not informing you about; The <br /> legal status of our historic water rights. These water rights are exempt from state <br /> regulation and/or legislative actions. They are grandfathered rights also known as <br /> "Pre-1914". Kevin immediately went to the podium to give you some facts in a <br /> misleading statement that mis-interpreted the settlement of the 1969 lawsuit. He <br /> did tell you our water rights are the original historic type of Pre-1914 type. That <br /> they are the "use it or lose it"form of water right and legally Surface Water <br /> Diversion rights. His statements were so far correct but vastly incomplete to the <br /> issue under discussion--thus misleading. <br />
