VC-O03 -001 RESOLUTION NO. 19837 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, CALiFORNiA, PROVIDING FOR THE SUMMARY VACATION OF A 3 PORTION OF MOTOR CIRCLE DRIVE. 4 WHEREAS, the City of Riverside proposes to vacate that portion of' Motor Circle Drive 5 described and depicted in Exhibit "A" attached hereto and incorporated by reference (hereinafter 6 "the Property"); and 7 WHEREAS, the Property is excess right-of-way not required for street or highway 8 purposes; and 9 WHEREAS, for a period of five consecutive years, the Property has been impassible for 10 vehicular travel in that it was never developed with a roadway nor opened tbr travek and no public 1 l money was expended for maintenance on the street during such period; and 12 WHEREAS, the adjoining properties will not be affected by the vacation of the Property; 13 and 14 WHEREAS, Section 8331 of the Streets and Highways Code provides that the legislative 15 body of a local agency may summarily vacate a street or highway if for a period of five consecutive 16 years, the street or highway has been impassable fbr vehicular travel and no public money was 17 expended for maintenance of the street of highway during such periodl and 18 WHEREAS, Section 8334 of the Streets and Highways Code provides that the legislative 19 body of a local agency may summarily vacate the excess right-of-way of a street or highway not 20 required for street or highway purposes; and 2 l WHEREAS, the City Council wishes to proceed under the provisions of Section 8330, et 22 seq. of the Street and Highways Code to summarily vacate the described Property 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Riverside, 24 California, as follows: 25 Section 1: The vacation the described Property is undertaken pursuant to the provisions 26 of Chapter 4 (commencing with Section 8330) of Part 3 of the Streets and Highways Code of the 27 State of California.
