1 EP-014-001 2 RESOLUTION NO. 19836 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERS[DE, CALIFORNIA, WAIVING THE PROVISIONS OF SECTION 5.07(a) OF 4 RESOLUTION NO. 19478 TO PROVIDE FOR REViEW AND CONSIDERATION OF AN ENVIRONMENTAL INITIAL STUDY BY CITY COUNCIL IN LIEU OF 5 THE PLANNING COMMISSION DUE TO EXIGENT CIRCUMSTANCES. 6 WHEREAS, on April 27, 1999, the City Council adopted Resolution No. 19478 setting 7 forth the objectives, criteria and procedures for administering the City of Riverside's responsibilities 8 under the California Environmental Quality Act (CEQA); and 9 WHEREAS, Section 5.07(a) of Resolution No. 19478 provides that the Planning I 0 Commission tbr the City of Riverside shall review the Environmental lnitial Study tbr various types 11 of projects, including public projects, and thereafter make appropriate recommendations to City 12 Council for final determination; and 13 WHEREAS, Case No. EP-014-001 involves the proposal of the City's Public Utilities 14 Department to rehabilitate and repair a 3,274 -foot long water transmission tunnel in the City of 15 Grand Terrace. which has deteriorated and poses the threat of flooding of surronnding properties if 16 the tunnel fails; and 17 WHEREAS. the needed repairs must be performed during the months of January. 18 February_ or March; and 19 WHEREAS, the procedure contained in Section 507(a) of Resolution No. 19478 would 20 add a minimum of 30 - 45 days to allow Planning Commission to review the Initial Stndy arid make 21 recommendations to City Council for final action. 22 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Riverside, 23 California, that the City Council finds as follows: 24 1.
