<br />5 <br /> <br />RESOLUTION NO. 19831 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, <br />CALIFORNIA, (1) ADOPTING THE COMPETITIVE PROCUREMENT PROCESS <br />CONDUCTED BY THE CITY OF TUSTIN FOR TREE MAINTENANCE SERVICES <br />AND FINDING THAT IT IS IN THE CITY'S BEST INTEREST TO DO SO, AND (2) <br />AUTHORIZING THE CITY MANAGER TO EXECUTE APPROPRIATE CONTRACT <br />DOCUMENTS FOR TREE MAINTENANCE SERVICES PROVIDED BY WEST <br />COAST ARBORISTS, INC. <br /> <br />2 <br />3 <br />4 <br /> <br />6 <br /> <br />WHEREAS, Section 201 (g) of Resolution 17788 provides that competitive procurement <br /> <br />7 is not required when services can be procured from a contractor who offers the same or better price, <br /> <br />8 terms and conditions as the contractor previously offered as the lowest responsible bidder under a <br /> <br />9 competitive procurement process conducted by another public agency (piggyback), provided that the <br /> <br />10 Purchasing Services Manager determines that it is the City's best interest to do so; and <br /> <br />11 WHEREAS, the City of Tustin conducted a competitive procurement process for its tree <br /> <br />12 maintenance services, wherein West Coast Arborists, Inc. ("WCA") was awarded the contract as the <br /> <br />13 lowest responsible bidder; and <br /> <br />14 WHEREAS, on May 16, 1997, based on the piggyback exception of Resolution 17788, <br /> <br />15 City entered into that certain Agreement for Tree Maintenance Services with WCA, wherein WCA <br /> <br />16 agreed to provide tree maintenance services for the City's Park & Recreation Department for the <br /> <br />17 term May 16, 1997, through June 30, 2001, with the option to extend the term for five additional <br /> <br />18 one year terms; and <br /> <br />19 <br /> <br />WHEREAS, on June 16, 1997, City entered into that certain Supplemental Agreement for <br /> <br />20 Tree Maintenance Services with WCA, wherein WCA agreed to provide line clearance tree <br /> <br />21 trimming for the Public Utilities Department for the term June 16, 1997, through June 30, 2001, <br />22 with the option to extend the term for five additional one year terms; and <br /> <br />23 <br /> <br />WHEREAS, WCA has offered to extend the terms of both the Agreement for Tree <br /> <br />24 Maintenance Services and Supplemental Agreement for Tree Maintenance Services (collectively <br /> <br />25 hereinafter referred to as "Agreement") for an additional ten years with no increase in their current <br /> <br />26 rate schedule; and <br />27 WHEREAS, several other Southern California cities (i.e. Brea, Costa Mesa, Culver City, <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(909) 826-5567 <br />
