• <br />City of Riverside, City Council <br />3900 Main St. <br />Riverside, CA 92522 <br />RE: Code of Ethics and Conduct Adjudicating Body — cure and correct demand <br />To Whom It May Concern, <br />September 22, 2014 <br />Jason Hunter <br />1325 Century Ave. <br />Riverside, CA 92506 <br />This letter is to call your attention to what I believe was a substantial violation of a central provision of the Ralph M. <br />Brown Act, one which may jeopardize the finality of the action taken by the Code of Ethics and Conduct Adjudicating <br />Body. <br />The nature of the violation is as follows: in its meeting of August 22, 2014, the Adjudicating Body took action finding <br />no violations of the City's Code of Ethics and Conduct regarding a complaint towards the actions of Mr. Justin Scott- <br />Coe. The action taken was not in compliance with the Brown Act because there was no adequate notice containing <br />the agenda for this meeting posted on the city's "Meetings Calendar" website. <br />I notified the City Clerk in writing last December of a similar violation as part of a previous ethics complaint hearing. I <br />followed up on that written complaint by orally advising the City Clerk of the same at a subsequent Governmental <br />Affair Committee meeting. I notified the City Clerk of this particular violation in the days preceding the August 22nd <br />hearing. I then proceeded to inform the Adjudicating Body of this violation at the hearing. Adjudicating Body <br />member, Robin Jackson, is on the record as being surprised by not being able to find notice of the hearing on the <br />city's website, as is one member of the public. <br />As you are aware, Section 54954.2(a)(1) of the Brown Act provides that at least 72 hours before a regular meeting, <br />the legislative body of the local agency, or its designee, shall post an agenda containing a brief general description of <br />each item of business to be transacted or discussed at the meeting, including items to be discussed in closed <br />session. A brief general description of an item generally need not exceed 20 words. The agenda shall specify the <br />time and location of the regular meeting and shall be posted in a location that is freely accessible to members of the <br />public and on the local agency's Internet Web site, if the local agency has one. <br />Pursuant to that provision (GC 54960.1), 1 demand that the Adjudicating Body of the city of Riverside cure and correct <br />the illegally taken action as follows: formal and explicit withdrawal from any determination made on August 22, 2014, <br />regarding the complaint of Code of Ethics and Conduct violations by Mr. Justin Scott-Coe; coupled with a disclosure <br />at a future Adjudicating Body meeting as to why the panel believed it had the authority to proceed with the hearing <br />
