VR-78-823 1 RESOLUTION NO. 14878 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, CALIFORNIA, RENDERING ITS DECISION GRANTING A VARIANCE. 2 3 4 WHEREAS, on December 20, 1982, the Board of Administrative Appeals and Zoning 5 Adjustment of the City of Riverside approved the application of Rod Frazer Enterprises (Don Jose's 6 Restaurant) in Zoning Case VR-78-823 for a variance to construct an addition to an established 7 restaurant which encroaches (A) an encroachment of 16 feet into the 108 foot special setback on 8 Magnolia Avenue; and (B) an encroachment of20 feet into the required 35 foot special building 9 setbacks adjacent to both Magnolia and La Sierra Avenues, subject to conditions as set forth in the 10 staff report; and 11 WHEREAS, Rod Frazer Enterprises requested the City Council adopt the determination 12 of the Board of Administrative Appeals and Zoning Adjustment; and 13 WHEREAS, the City Council of the City of Riverside conducted a public hearing on 14 January 25,1983, in the matter of said appeal. 15 NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Riverside 16 that it be and is hereby found and determined from the facts and conditions shown by the evidence 17 at the public hearing and by the investigation of the City Council that the conditions set forth in 18 Section 19.64.130B exist, and the granting of the variance will be in harmony with the general 19 purpose and intent of the Riverside Municipal Code. 20 BE IT FURTHER RESOLVED that the variance as approved by the Board of Zoning 21 Adjustment are hereby granted subject to the conditions set forth in the report by the Planning 22 Commission of the City of Riverside. 23 III 24 I I I 25 III 26 III 27 III Note: Ronald Loveridge was not Mayor on 1-25-83.
