<br />9 <br />10 <br />11 <br />12 <br />13 <br /> <br />14 <br /> <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br /> <br />27 <br /> <br />28 <br /> <br />29 <br />30 <br /> <br />31 <br />11/30/82 <br />CC/jm 32 <br /> <br />CITY ATTORNEY <br />RIVERSIDE <br />CALIFORNIA <br /> <br />RESOLUTION NO. 14868 <br /> <br />2 <br />3 <br />4 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />RIVERSIDE, CALIFORNIA, GRANTING TO THE PERSONNEL <br />BOARD THE POWER TO COMPEL THE ATTENDM~CE OF <br />WITNESSES, TO EXAMINE THEM UNDER OATH, TO COMPEL <br />THE PRODUCTION OF EVIDENCE AND TO ADMINISTER OATHS <br />k~D AFFIRMATIONS AND ESTABLISHING THAT SUBPOENAS <br />ISSUED UNDER THIS GRANT OF AUTHORITY HAVE THE <br />SAME FORCE AND EFFECT AS THOSE ISSUED BY THE CITY <br />COUNCIL. <br /> <br />5 <br /> <br />6 <br />7 <br />8 <br /> <br />~iHEREAS the City Personnel Board is charged with holding <br /> <br />evidentiary administrative hearings on certain grievances; and <br /> <br />WHEREAS the ability to subpoena witnesses and documents <br /> <br />and to examine witnesses under oath is necessary to carry out <br /> <br />such hearings; and <br /> <br />WHEREAS the Charter of the City of Riverside adopted on <br /> <br />November 17, 1981, grants to the City Council the sole authority <br /> <br />to grant power to issue subpoenas and to examine witnesses under <br /> <br />oath; and <br /> <br />WHEREAS under the previous Charter, the boards were <br /> <br />granted this authority directly and it was frequently necessary <br /> <br />to issue subpoenas; and <br /> <br />WHEREAS the Personnel Board made a formal request for <br /> <br />such authority at their November 15, 1982 meeting; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Personnel Board <br /> <br />be granted the power and authority to compel the attendance of <br /> <br />witnesses, to examine them under oath, to compel the production <br /> <br />of evidence before it and to administer oaths and affirmations. <br /> <br />BE IT FURTHER RESOLVED that subpoenas issued under this <br /> <br />grant of authority have the same force and effect as subpoenas <br /> <br />issued by the City Council and therefore disobedience of such <br /> <br />subpoenas or the refusal to testify (upon other than Constitution <br /> <br />grounds) shall constitute a misdemeanor, punishable in the same <br /> <br />manner as other violations of the Charter of the City of <br /> <br />Riverside. <br />
