<br />, <br /> <br />CITY OF RIVERSIDE <br /> <br />REDEVELOPMENT AGENCY MEMORANDUM <br /> <br />Honorable Mayor & Agency Members <br /> <br />Date: <br />Item No.: <br /> <br />July 11, 2000 <br />5 <br /> <br />Subject: General Information Concerning Conditions and Restrictions on Cumulative Occupancy of <br />Hotels and Motels <br /> <br />Background <br /> <br />At its meeting of June 6,2000, while discussing a relocation plan for a motel on University Avenue, the <br />Redevelopment Agency noted that long-term occupancy of hotels and motels could have an impact on projects <br />along the University Avenue Corridor or other Redevelopment areas. To investigate ways to alleviate this issue, <br />the Agency directed staffto research ordinances in other cities that restrict the duration of occupancy for hotel and <br />motel units. Staff followed up this request, contacting several cities in the State of California. Staff found that <br />some cities created specific ordinances to limit hotel/motel occupancy, while others included conditional language <br />in their definition of hotel/motel that specified transient occupancy. The following report gives examples of <br />ordinances or definitions that other cities have used. For a more complete listing of staffs findings, please refer <br />to Attachment A. <br /> <br />Survey Results <br /> <br />Buena Park: Limitation on Continuous and Cumulative Occupancy of Hotels, Motels, and Motor Hotels. It shall <br />be unlawful for any hotel, motel, or motor hotel to rent or let, or otherwise provide, any room therein to <br />any person, firm, partnership, corporation, association or other business entity for thirty (30) or more <br />consecutive days, or for more than sixty (60) total days in anyone hundred and eighty (180) consecutive <br />day period. .. (City of Buena Park Municipal Code Ordinance No. 1399, Text Amendment No. C 99-2). <br /> <br />Greenfield: Transient Occupancy of a HotellMotel: Any person occupying space in a hotel or motel shall be <br />deemed a transient until the period of thirty (30) days has expired. If occupancy in a hotel or motel <br />continues after this 30 day period in a hotel or motel, the facility and individual shall be in violation of <br />this ordinance and subject to the provisions dealing with enforcement, violations, and penalties. If length <br />of stay is extended for any reason, transient occupancy tax will be paid for all days any unit is occupied. <br />(City of Greenfield Municipal Code Section 17.51.030) <br /> <br />Long Beach: 'Hotel' means a commercial land use for the rental of six (6) or more guest rooms or suites to <br />primarily transient occupants for a period of not more than thirty (30) consecutive days (City of Long <br />Beach Municipal Code Section 21.15.1380). <br /> <br />San Gabriel: No occupancy or registration of any unit, or any portion thereof, other than the manager's quarters, <br />by any person shall exceed twenty-one (21) calendar days in any consecutive ninety (90) calendar day <br />period (City of San Gabriel Municipal Code Section 5-29.02). <br /> <br />Analysis <br /> <br />If the Agency Board is desirous of seeing changes made to the way in which transient occupancy for hotels and <br />motels is defined and restricted, ordinance amendments to the City's Municipal Code would be required. The <br />amendments would need to be initiated by the City Council. Adopting an ordinance similar to those listed above <br />would provide the City with a way to ensure that hotels and motels remain transient lodging locations. Such an <br />ordinance would help prevent code violations and substandard living conditions created when people u,se hotels <br />and motels as permanent housing even though such buildings do not meet housing zoning codes. <br /> <br />Staff notes that the information presented in this report is a sampling of ordinances adopted by other California <br />cities. Staff is still researching the impact that adopting such an ordinance would have on the City, including the <br /> <br />5-1 <br />
