A. McElroy, Zoning Case V-15-790, <br />for a variance from the front and rear yard setback requirements <br />of Section 19.10.080, the lot coverage requirements of Section <br />19.10.070, and the railing height requirements of Section 19.70.120 <br />of the Riverside Municipal <br /> <br /> David K. McElroy and Judith A. McElroy appealed to the <br />City Council from the determination of the Board of Zoning <br />Adjustment. The City Council of the City of Riverside conducted <br />a public hearing on January 8, 1980, in the matter of said appeal. <br /> <br /> RESOLVED by the City Council of the City of Riverside <br /> <br />that it be and is hereby found and determined from the facts <br />and conditions shown by the evidence at the public hearing and <br />by the investigation of the City Council that the conditions <br />set forth in Section 19.64.130 (b) exist, and the granting of <br />the variance with a height limitation of 25 feet will be in <br />harmony with the general purpose and intent of the Riverside <br />Municipal Code. <br /> <br /> RESOLVED FURTHER that a variance be and is hereby granted <br />for the purpose of constracting a single-family dwelling which <br />will encroach approximately 8 feet into the required 25-foot <br />front yard setback, encroach approximately 4 feet into the <br />required 30-foot rear yard setback, provide no level rear yard <br />where 30 feet is required, cover 31% of the lot where a maximum <br />of 30% is permitted and to construct a railing enclosing decks <br />encroaching into the front and rear yards and exceeding the <br />maximum height permitted, as shown on the plot plan and in <br />accordance with the terms and conditions of approval, provided <br /> <br /> <br />
