,/7/80 P/jm RESOLUTION NO. 13989 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, CALIFORNIA, URGING AND AUTHORIZING CALTRANS TO TAKE IM/~_EDIATE ACTION TO ACQUIRE THE SOUTHERN PACIFIC TRANSPORTATION COMPANY RIGHT-OF- WAY IN ~GNOLIA AVENUE FROM BANBURY DRIVE SOUTHERLY TO THE CITY LIMITS. 6 WHEREAS on November 22, 1977, the City of Riverside and 7 the State of California acting by and through its Business and 8 Transportation Agency, Department of Transportation (hereinafter 9 referred to as "Caltrans") entered into a Cooperative Agreement 10 for Acquisition of an Abandoned Railroad Line wherein Caltrans 11 was authorized and directed to acquire in the name of the City 12 the Southern Pacific Transportation Company right-of-way in 13 Magnolia Avenue from Banbury Drive southerly to the city limits; 14 and 15 WHEREAS pursuant to said agreement, Caltrans obtained 16 an appraisal of the property sought to be acquired and made an 17 offer based thereon to the Southern Pacific Transportation 18 Company; and 19 WHEREAS said offer was not accepted and no further 20 action has been taken by Caltrans; and 21 WHEP~EAS an extensive amount of time has elapsed since 22 the City and Caltrans entered into the Cooperative Agreement for 23 Acquisition of an Abandoned Railroad Line; and 24 WHEREAS property values may increase, thereby resulting 25 in increased acquisition costs if prompt action to acquire the 26 subject right-o[-way is not taken; and 27 WHEREAS due to the intensified commercial growth in the 28 area, portions of the subject property are critically needed to 29 permit the installation of traffic signals and for left turn 30 storage lanes; and 31 WHEREAS immediate acquisition of the subject property 32 is necessary for the installation of the Magnolia Avenue sewer
