,/7/80 <br />P/jm <br /> <br />RESOLUTION NO. 13989 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />RIVERSIDE, CALIFORNIA, URGING AND AUTHORIZING <br />CALTRANS TO TAKE IM/~_EDIATE ACTION TO ACQUIRE THE <br />SOUTHERN PACIFIC TRANSPORTATION COMPANY RIGHT-OF- <br />WAY IN ~GNOLIA AVENUE FROM BANBURY DRIVE SOUTHERLY <br />TO THE CITY LIMITS. <br /> <br />6 WHEREAS on November 22, 1977, the City of Riverside and <br />7 the State of California acting by and through its Business and <br />8 Transportation Agency, Department of Transportation (hereinafter <br />9 referred to as "Caltrans") entered into a Cooperative Agreement <br />10 for Acquisition of an Abandoned Railroad Line wherein Caltrans <br />11 was authorized and directed to acquire in the name of the City <br />12 the Southern Pacific Transportation Company right-of-way in <br />13 Magnolia Avenue from Banbury Drive southerly to the city limits; <br />14 and <br />15 WHEREAS pursuant to said agreement, Caltrans obtained <br />16 an appraisal of the property sought to be acquired and made an <br />17 offer based thereon to the Southern Pacific Transportation <br />18 Company; and <br />19 WHEREAS said offer was not accepted and no further <br />20 action has been taken by Caltrans; and <br />21 WHEP~EAS an extensive amount of time has elapsed since <br />22 the City and Caltrans entered into the Cooperative Agreement for <br />23 Acquisition of an Abandoned Railroad Line; and <br />24 WHEREAS property values may increase, thereby resulting <br />25 in increased acquisition costs if prompt action to acquire the <br />26 subject right-o[-way is not taken; and <br />27 WHEREAS due to the intensified commercial growth in the <br />28 area, portions of the subject property are critically needed to <br />29 permit the installation of traffic signals and for left turn <br />30 storage lanes; and <br />31 WHEREAS immediate acquisition of the subject property <br />32 is necessary for the installation of the Magnolia Avenue sewer <br /> <br /> <br />
