A. Owner is the owner of that certain real property ("Property") located in the City of Riverside, County of Riverside, State of California, described in Exhibit "A" attached hereto and incorporated herein by this reference. B. By that certain Grant Deed ("1976 Deed") recorded August 31, 1976, as Instrument No. 130104, Official Records, Riverside County, Agency conveyed the Property to Safeway Stores, Incorporated, a Maryland corporation ("Safeway"), Owner's predecessor-in- interest. In the 1976 Deed, Safeway, by and for itself, its successors, assigns and all persons claiming under or through Safeway, made and entered into certain covenants for the benefit of Agency. The 1976 Deed incorporated by reference that certain Contract for Sale of Land ("Contract") dated September 1, 1995, by and between Safeway and Agency. All covenants made by Safeway for the benefit of Agency in the 1976 Deed and/or the Contract are hereafter collectively referred to as the "Covenants." C. Owner and Agency desire to terminate the Covenants as of the date hereof. NOW, THEREFORE, for good and valuable consideration, the receipt ad sufficiency of which is hereby acknowledged, Owner and Agency agree that the Covenants are terminated and shall be of no further force and effect as of the date hereof.
