V CPT, OF �� City Council Memorandum City,„1..,its c Inraovat io TO: HONORABLE MAYOR AND CITY COUNCIL DATE: DECEMBER 18, 2012 FROM: PARKS, RECREATION AND COMMUNITY ITEM NO: 29 SERVICES DEPARTMENT WARD: 1 SUBJECT: SEIZING OUR DESTINY — BID NO. 7016 - RYAN BONAMINIO PARK AT THE TEQUESQUITE ARROYO - INCREASE CHANGE ORDER AUTHORITY ISSUE: The issue for City Council consideration is approval of an increase in the change order authority for Bid No. 7016 - Ryan Bonaminio Park at the Tequesquite Arroyo for off-site street improvements on the north side of Tequesquite Avenue. RECOMMENDATIONS: That the City Council: 1. Authorize an increase of $378,952 to the cumulative change order authority for Bid No. 7016 - Ryan Bonaminio Park at the Tequesquite Arroyo for off-site street improvements on Tequesquite Avenue; and 2. Authorize the City Manager, or his designee, to execute additional change orders not- to-exceed 10% of the revised contract amount of $8,108,754. BACKGROUND: On December 6, 2011, the City Council awarded a construction contract to C.S. Legacy Construction, Inc., Chino, California (Contractor), for the construction of Ryan Bonaminio Park at the Tequesquite Arroyo, Bid No. 7016 in the amount of $6,585,582. On June 26, 2012, the City Council authorized the completion of Additive Bid Item 11.13 from the contractor's original bid item to construct off-site street improvements, including the south side of Tequesquite Avenue utilizing funding from the Public Works Department in the total amount of $560,000. The Public Works Department has since completed improvement plans for the north side of Tequesquite Avenue to provide full-width street improvements from Wong Street westerly to Elderwood Court. The Contractor provided a fair and reasonable cost proposal in the amount of $378,952 to complete the northerly street improvements including new curb, gutter and sidewalk, as well as the rehabilitation of damaged existing sidewalk. 29-1
