City Council Memorandum <br /> R IVEF-5II]E <br /> r <br /> ................................................................................................................. <br /> TO: HONORABLE MAYOR AND CITY COUNCIL DATE: DECEMBER 18, 2012 <br /> FROM: PARKS, RECREATION AND COMMUNITY ITEM NO: 22 <br /> SERVICES DEPARTMENT <br /> WARDS: ALL <br /> SUBJECT: COMMUNITY GARDEN POLICY UPDATE—SUPPLEMENTAL APPROPRIATION <br /> FROM THE GENERAL FUND RESERVES <br /> ISSUES: <br /> The issues for City Council consideration are: 1) receive an update regarding the Community <br /> Garden Policy; 2) approve the waiver of liability insurance within the Community Garden Policy <br /> ("Policy"); 3) approve a water cost share within the Community Garden Policy; and 4) approve <br /> supplemental appropriation from the General Fund reserves. <br /> RECOMMENDATIONS: <br /> That the City Council: <br /> 1. Receive an update on the Community Garden Policy; and <br /> 2. Approve the waiver of liability insurance within the Community Garden Policy; <br /> 3. Approve a 50/50 monthly water use cost share within the Community Garden Policy; and <br /> 4. Approve a supplemental appropriation in the amount of $2,500 from the General Fund <br /> reserves to an account as established by the Finance Department for the community <br /> garden water utility costs for Fiscal Year 2012/13 and for backflow theft prevention cage <br /> installation costs at the Arlanza Garden. <br /> COMMITTEE RECOMMENDATION: <br /> At the June 11, 2012, the Community Services and Youth Committee, with Chair Davis, Vice Chair <br /> Hart and Member Bailey present, directed staff to revise the draft Policy to address the concerns <br /> of community groups in providing the required liability insurance and the potential water costs to <br /> irrigate the gardens and return to the Committee in two months. The Committee also asked that <br /> the garden operators require all participants to sign liability waivers prior to being assigned a plot. <br /> 22-1 <br />
