TO: HONORABLE MAYOR AND CITY COUNCIL DATE: DECEMBER 18, 2012 FROM: PARKS, RECREATION AND COMMUNITY ITEM NO: 22 SERVICES DEPARTMENT WARDS: ALL SUBJECT: COMMUNITY GARDEN POLICY UPDATE—SUPPLEMENTAL APPROPRIATION FROM THE GENERAL FUND RESERVES ISSUES: The issues for City Council consideration are: 1) receive an update regarding the Community Garden Policy; 2) approve the waiver of liability insurance within the Community Garden Policy ("Policy"); 3) approve a water cost share within the Community Garden Policy; and 4) approve supplemental appropriation from the General Fund reserves. RECOMMENDATIONS: That the City Council: 1. Receive an update on the Community Garden Policy; and 2. Approve the waiver of liability insurance within the Community Garden Policy; 3. Approve a 50/50 monthly water use cost share within the Community Garden Policy; and 4. Approve a supplemental appropriation in the amount of $2,500 from the General Fund reserves to an account as established by the Finance Department for the community garden water utility costs for Fiscal Year 2012/13 and for backflow theft prevention cage installation costs at the Arlanza Garden. COMMITTEE RECOMMENDATION: At the June 11, 2012, the Community Services and Youth Committee, with Chair Davis, Vice Chair Hart and Member Bailey present, directed staff to revise the draft Policy to address the concerns of community groups in providing the required liability insurance and the potential water costs to irrigate the gardens and return to the Committee in two months. The Committee also asked that the garden operators require all participants to sign liability waivers prior to being assigned a plot. 22-1
