CWAN'OF <br /> 1 SIDE <br /> ;r,ty, � . ,��, City Council Memorandum vation <br /> TO: HONORABLE MAYOR AND CITY COUNCIL DATE: December 18, 2012 <br /> FROM: CITY ATTORNEY ITEM NO: 18 <br /> WARDS: ALL <br /> SUBJECT: REIMBURSEMENT OF ATTORNEY'S FEES AND COSTS <br /> ASSOCIATED WITH THE ADMINISTRATIVE CODE ENFORCEMENT <br /> ACTION AND REHABILITATION OF THE PROPERTY AT <br /> 3282 ALGONQUIN LANE — SUPPLEMENTAL APPROPRIATION <br /> ISSUE: <br /> The issue presented for consideration by the City Council is whether to accept reimbursement <br /> for fees and costs expended by the City Attorney's Office in connection with the administrative <br /> code enforcement action and rehabilitation of the property located at 3282 Algonquin Lane. <br /> RECOMMENDATIONS: <br /> That the City Council: <br /> 1. Approve the acceptance of $2,700.00 for attorney's fees and costs associated with the <br /> code enforcement action and rehabilitation of the property at 3282 Algonquin Lane; and <br /> 2. Increase revenues and appropriate expenditures in the amount of $2,700.00 to Special <br /> Program Account Number 1300000-450239. <br /> BACKGROUND: <br /> The property at 3282 Algonquin Lane (Ward 5) has been the subject of an administrative code <br /> enforcement action for landscape and exterior maintenance violations. The City of Riverside <br /> has been able to successfully negotiate a rehabilitation agreement with the property owner. In <br /> exchange for the payment of $20,000.00 in administrative civil penalties and $2,700.00 in <br /> attorney's fees, the property owner has agreed to correct all violations and maintain the property <br /> in compliance with Chapters 6.11 and 6.14 of the Riverside Municipal Code. <br /> 18-1 <br />
