CWAN OF <br /> ,!VE StDE <br /> ;r,�, � . ,��, City Council Memorandum ion <br /> TO: HONORABLE MAYOR AND CITY COUNCIL DATE: December 11, 2012 <br /> FROM: CITY ATTORNEY ITEM NO: 27 <br /> WARDS: ALL <br /> SUBJECT: REIMBURSEMENT OF ATTORNEY'S FEES AND COSTS ASSOCIATED <br /> WITH THE ADMINISTRATIVE CODE ENFORCEMENT ACTION AND <br /> REHABILITATION OF THE PROPERTY AT 1057 MAIN STREET — <br /> SUPPLEMENTAL APPROPRIATION <br /> ISSUE: <br /> The issue presented for consideration by the City Council is whether to accept reimbursement <br /> for fees and costs expended by the City Attorney's Office in connection with the administrative <br /> code enforcement action and rehabilitation of the property located at 1057 Main Street. <br /> RECOMMENDATIONS: <br /> That the City Council: <br /> 1. Approve the acceptance of $3,000.00 for attorney's fees and costs associated with the <br /> code enforcement action and rehabilitation of the property at 1057 Main Street; and <br /> 2. Increase revenues and appropriate expenditures in the amount of $3,000.00 to Special <br /> Program Account Number 1300000-450239. <br /> BACKGROUND: <br /> The property at 1057 Main Street (Ward 1) has been the subject of an administrative code <br /> enforcement action for landscape and exterior maintenance violations. The City of Riverside <br /> has been able to successfully negotiate a rehabilitation agreement with the property owner. In <br /> exchange for the payment of $30,000.00 in administrative civil penalties and $3,000.00 in <br /> attorney's fees, the property owner has agreed to correct all violations and maintain the property <br /> in compliance with Chapters 6.11 and 6.14 of the Riverside Municipal Code. <br /> 27-1 <br />
