CW4N'Off <br /> � �I~D City Council Memorandum <br /> City 0"Arts&Innovation TO: HONORABLE MAYOR AND CITY COUNCIL DATE: December 11, 2012 <br /> FROM: PUBLIC WORKS DEPARTMENT ITEM NO: 22 <br /> WARDS: All <br /> SUBJECT: RESIDENTIAL AND COMMERCIAL SOLID WASTE SERVICES — FIVE <br /> YEAR RATE INCREASE STRUCTURE <br /> ISSUES: <br /> The issue for City Council consideration is mailing notices and setting a public hearing for <br /> consideration of a five-year refuse rate increase for residential and commercial solid waste <br /> services for the period from July 1, 2013 to June 30, 2018. <br /> RECOMMENDATIONS: <br /> That the City Council: <br /> 1. Direct staff to prepare and mail notice to rate payers informing them about the <br /> proposed five-year rate increase for residential and commercial solid waste <br /> services, as required by Proposition 218; and <br /> 2. Direct staff to set a public hearing for the proposed five-year rate increase for <br /> residential and commercial solid waste services on a date at least forty-five days <br /> after mailing of the notice. <br /> COMMITTEE RECOMMENDATION: <br /> On November 15, 2012, the Utility Services/Land Use/Energy Development Committee (Chair <br /> Bailey, Vice Chair Gardner, and Member Davis present) unanimously recommended that the <br /> City Council direct staff to mail notices and set a public hearing date for consideration of a five- <br /> year rate increase for residential and commercial solid waste services. <br /> BACKGROUND: <br /> On June 24, 2008, City Council approved a rate structure for residential and commercial <br /> solid waste services. The residential rate structure was approved for a five-year period from <br /> July 1, 2008 to June 20, 2013. The commercial rate structure was approved for a ten-year <br /> period from July 1, 2008 to June 30, 2018. Both rates provided for annual increases based <br /> upon inflation (as set by the Consumer Price Index). Since that time, State law has limited the <br /> length of such annual inflationary increases to five years. With the upcoming expiration of the <br /> fifth year of the current commercial structure, this item is presented to introduce the proposed <br /> 22-1 <br />
