CU-021-990 1 2 3 4 5 6 7 8 9 RESOLUTION NO. 19621 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE RENDERING ITS DECISION GRANTING THE APPEAL FOR A MINOR CONDITIONAL USE PERMIT SUBJECT TO SPECIFIC CONDITIONS AT 3812 PIERCE ST., UNIT B, RIVERSIDE, CA. WHEREAS, the City Council of the City of Riverside conducted a public hearing on December 14, 1999, in the matter of the appeal by applicant Fred Chandler on behalf of legal owner, Stephen J. Mascaro in Zoning Case CU-021-990 for a minor conditional use permit to allow the on- sale of beer and wine in a bar to be located in an existing lease space at 3812 Pierce Street, Unit B, in the C-2-Restricted Commercial Zone. The original application having been denied by the 10 Planning Commission on November 18, 1999 and thereafter, appealed by applicant on November 11 29, 1999. 12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Riverside 13 that it is hereby found and determined from the facts and conditions shown by the evidence at the 14 public hearing and by the previous investigation of the Planning Commission that the proposed use, 15 as previously denied by the Planning Department, could be modified to be substantially compatible 16 with other existing and proposed uses in the area, including factors relating to the nature of its 17 location, operation, building design, site design, traffic characteristics and environmental impacts; 18 the proposed use will not be materially detrimental to the health, safety and general welfare of the 19 public or otherwise injurious to the environment or to the property or improvements within the area; 20 and the proposed use will be consistent with the purposes of Title 19 of the Riverside Municipal 21 Code. 22 BE IT FURTHER RESOLVED that a minor conditional use permit is hereby granted in 23 Zoning Case CU-021-990; and subject to compliance with all required terms and conditions of this 24 use permit, including, but not limited to the following amended conditions: 25 (1) Condition No. 10 shall be amended to set hours of operation to be 10:00 a.m. to 26 12:00 a.m. Sunday through Thursday and 10:00 a.m. to 1:00 a.m. on Friday and Saturday; 27 (2) Appellant shall prepare and provide a security plan to the City of Riverside Police City Attorney's Office 3900 Main Street Riverside, CA 92522 (909) 782-5567
