F CWvw'Off <br /> � ���E <br /> I City Council Memorandum <br /> City 0"Arts&Innovation TO: HONORABLE MAYOR AND CITY COUNCIL DATE: September 11, 2012 <br /> FROM: PUBLIC WORKS DEPARTMENT ITEM NO: 22 <br /> WARD: 1 <br /> SUBJECT: IOWA AVENUE GRADE SEPARATION AT BURLINGTON NORTHERN SANTA <br /> FE (BNSF) RAILROAD—FIRST AMENDMENT TO PROFESSIONAL SERVICES <br /> AGREEMENT WITH HILL INTERNATIONAL, INC. <br /> ISSUE: <br /> The issue for City Council consideration is approval of the First Amendment to the Professional <br /> Consultant Services Agreement with Hill International, Inc. to expand the scope of services to <br /> include materials testing services and contract provisions required in a federal aid project. <br /> RECOMMENDATIONS: <br /> That the City Council approve the First Amendment to the Professional Consultant Services <br /> Agreement with Hill International, Inc., of Ontario, California, in an amount not to exceed by <br /> $249,930 increasing the total fee from $1,085,536 to $11,335,466. <br /> BACKGROUND: <br /> On June 26, 2012, the City Council approved a $1,085,536 Professional Consultant Services <br /> Agreement with Hill International, Inc. for construction management services for the Iowa <br /> Avenue Grade Separation at BNSF Railroad project. The project includes $8.67 million in <br /> Federal funding. The Federal funds require that the City's agreements for the project include <br /> certain provisions relating to disadvantaged businesses among other requirements. <br /> The Request for Proposals for the construction management services required the selected <br /> consultant to conform to the Federal requirements; however, when the agreement was <br /> executed, the necessary Federal provisions were not included. This Amendment will <br /> incorporate the Federal provisions with no increase in cost. <br /> Also, at the time of award of the Professional Services Agreement, the Public Works <br /> Department intended to utilize one of the existing on-call materials testing firms for the project; <br /> however, it was later determined that the Request for Proposals for the On-Call Firms did not <br /> include the provisions required when utilizing Federal funds. The Public Works Department is <br /> recommending that the materials testing be included with the services provided by Hill <br /> International. <br /> The addition of the materials testing scope of work will increase the cost of the construction <br /> Management Services by $249,930 from $1,085,536 to $1,335,466. <br /> 22-1 <br />
