P12-0066•Page 3
Access to adjoining properties will not be affected.
The proposed summary vacation intends to remove excess public right-of-way currently
consisting of landscaped frontage and a surface parking lot for the La Sierra Academy.
No physical improvements are proposed in conjunction with this request that could
affect adjoining properties and no other properties take access from the area proposed
to be vacated. Adjoining properties now have, and will continue to have, direct access
to either Golden Avenue or Pierce Street. Therefore, no changes to existing streets or
access points will result from this proposal and access to adjoining properties will not be
affected.
This portion of the street has been closed and impassable as a public road and
no public funds have been expended on its maintenance for the last five years.
The portion of the right-of-way to be summarily vacated is impassible as a public road
given that it consists of landscaping and portions of parking spaces within a surface
parking lot for the La Sierra Academy. As noted above, the subject area to be vacated
does not serve as a connection to other public right-of-way areas given that Golden
Avenue and Pierce Street are already fully developed. In fact, the La Sierra Academy
currently maintains the area to be vacated since it functions as part of their property and
has done so since 1964. Therefore, no public funds have been expended on the
maintenance of this right-of-way area in the five years.
FISCAL IMPACT:
There is no General Fund Impact. All project costs are borne by the applicant.
Prepared by: Al Zelinka, FAICP, Community Development Director
Certified as to
availability of funds: Brent A.
