ART PICK COUNCIL CHAMBER, CITY HALL 3900 MAIN STREET City ofArts Unnovation WARDS A D N E R 1 E E N D E z 2 A L E Y 3 A I S 4 A C A R H U R 5 A T 6 D M S 7 Roll Call: Present X X X X X X X Mayor Loveridge called the meeting to order at 3 p.m. PUBLIC HEARING CASE P11-0543 - VACATION - 7431 AND 7451 MAGNOLIA - RESOLUTION Hearing was called to consider a vacation of an approximately 42 -foot by 108 -foot segment of public right-of-way along the frontage of 7431 and 7451 Magnolia Avenue, currently developed with an apartment complex consisting of two buildings and related parking areas in conjunction with Cases P11-0762 and P11-0763 for design review of on-site parking area expansion into the vacated public right-of-way and a variance to allow for a reduced landscape setback along Magnolia Avenue in the R-3-1500 - Multiple Family Residential Zone. No one spoke on the matter. The public hearing was officially closed. Following discussion, the City Council (1) determined the proposed project will not have a significant effect on the environment based upon the findings set forth in the case record and adopted a Negative Declaration; (2) approved Case P11-0543 based on and subject to the Planning Commission findings and recommended conditions as outlined in the written staff report; and (3) adopted a resolution and instructed the City Clerk that it is not to be recorded until all conditions have been met; whereupon, the title having been read and further reading waived, Resolution No. 22383 of the City Council of Riverside, California, Making its Findings and Determinations in the Matter of Resolution of Intention No. 22376; and Making its Order Vacating a Portion of the Public Right -of -Way Situated Motion X Along the Frontage of 7431 and 7451 Magnolia Avenue, in Riverside, Second X California, was presented and adopted. All Ayes ORAL COMMUNICATIONS FROM THE AUDIENCE There were no comments at this time. CLOSED SESSION The City Council recessed to the City Council Board Room for a closed session pursuant to Government Code §54956.9(a) to confer with and/or receive advice from legal counsel concerning Donna Dupree v. Diamond Parking, Inc., et al., Riverside Superior Court Case No. RIC538117. RECESS The City Council recessed at 3:18 p.m. and reconvened at 6:15 p.m. 97-292
