City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCILDATE: April 24, 2012 <br />FROM: PUBLIC WORKS DEPARTMENT ITEM NO: <br />WARD: ALL <br />SUBJECT: PROPOSED AMENDMENT TO THE BAIL SCHEDULE PURSUANT TO SECTION <br />9.08.165 OF THE RIVERSIDE MUNICIPAL CODE, PARKING OF RECREATIONAL <br />VEHICLES IN CITY PARKS—RESOLUTION <br />ISSUE: <br />The issue for City Council consideration is whether to adopt a Resolution to amend the Bail <br />Schedule for the purpose of regulating the parking of recreational vehicles within a park or <br />recreation area owned or controlled by the City pursuant to Ordinance No. 7165. <br />RECOMMENDATIONS: <br />That the City Council adopt the attached Resolution amending the Bail Schedule to establish a base <br />fee of $116 per violation of proposed Section 9.08.165 of the Riverside Municipal Code, Parking of <br />Recreational Vehicles in City Parks, and a delinquent fee of $100 as outlined in the report. <br />BACKGROUND: <br />On March 27, 2012, the City Council introduced an ordinance amending Chapter 9.08 of the <br />Riverside Municipal Code to regulate the increased use of recreational vehicles for dwelling <br />purposes on public and private property, including parks and recreation areas. The use of <br />recreational vehicles for dwelling purposes, specifically those stopped within a park or recreation <br />area owned or controlled by the City, poses danger to the public health, safety and welfare of the <br />residents of the City. The parking of these vehicles within City parks also poses obvious traffic and <br />safety risks to the public, especially for children who are present within the park. These vehicles <br />also require the use of multiple parking spaces thus reducing the spaces available for park users. <br />The proposed ordinance will allow recreational vehicles within the City parks with the permission of <br />the Parks and Recreation Director with the issuance of a permit pursuant to Section 9.08.120. <br />The proposed Resolution is submitted to amend the Bail Schedule to establish a base fee of $116 <br />per violation of proposed Section 9.08.165 and a delinquent fee of $100 consistent with similar <br />parking violations, such as those violations issued under Section 10.44.175 of the Riverside <br />Municipal Code. <br />
