FACILITY USE AGREEMENT BETWEEN CITY OF RIVERSIDE AND SPECIAL OLYMPICS SOUTHERN CALIFORNIA, INC. (Shamel Park Pool) THIS FACILITY USE AGREEMENT ( "Agreement ") is entered into this _ day of , 20 , by and between the CITY OF RIVERSIDE, a California charter city and municipal corporation (hereinafter referred to as "City ") and SPECIAL OLYMPICS SOUTHERN CALIFORNIA, INC., a California non- profit corporation, (hereinafter referred to as "USER GROUP "). City and USER GROUP are sometimes referred herein individually as "Party" and collectively as "Parties." RECITALS A. City is fee owner of that certain real property, Shamel Park Swimming Pool located at 3650 Arlington Avenue, Riverside California 92506 (hereinafter referred to as "Premises "). A detailed description of the Premises is attached hereto as Exhibit "A ". B. USER GROUP desires to use the Premises and City is willing to allow USER GROUP use of the Premises for the sole purpose of providing pool space for aquatic activities, as well as team events, meetings and fundraisers for the USER GROUP. NOW, THEREFORE, in consideration of the above facts and for the promises and mutual covenants contained herein, the receipt and adequacy of which are hereby acknowledged; the Parties agree as follows: 1. Effective Date; Term; Termination 1.1 This Agreement shall become effective on the date first written above ( "Effective Date "), on which all of the following are true: (i) This Agreement has been approved and executed by the appropriate authorities of USER GROUP and this Agreement has been delivered to USER GROUP; and (ii) Following all legally required notices and hearings, this Agreement has been approved by the USER GROUP governing board, has been executed by the appropriate authorities of USER GROUP and delivered to City. 1.2 Term Upon the Effective Date, City hereby allows use to USER GROUP, on the terms and conditions hereinafter set forth, of the Premises. The term of this Agreement ( "Term "), shall commence on the Effective Date and shall remain in effect for five (5) years. -1- 24-3
