TO: HONORABLE MAYOR AND CITY COUNCIL DATE: March 20, 2012 FROM: POLICE DEPARTMENT ITEM NO: 33 WARDS: ALL SUBJECT: POLICE DEPARTMENT ASSET FORFEITURE BUDGET - SUPPLEMENTAL APPROPRIATION ISSUE: The issue for City Council consideration is approval of the 2012 Asset Forfeiture budget in the amount of $776,682. RECOMMENDATIONS That the City Council: 1. Approve the expenditures totaling $776,682 for the law enforcement related items as outlined in this report; and 2. Authorize a supplemental appropriation in the amount of $492,082 from the Federal Asset Forfeiture Account No. 0000721-225111; $151,600 from the Federal Treasury Asset Forfeiture Account No. 0000721 - 225112; and $133,000 from the State Asset Forfeiture Account No. 0000721-225110 to the ,appropriate Police Department accounts shown on the attached spreadsheet. BACKGROUND Federal and State legislation allows for funds seized by law enforcement during the investigation of specific narcotics law violations to be forfeited to the investigating law enforcement organizations. These funds are restricted in use to law enforcement and must be used to supplement, not supplant, the Police Department's annual budget. The proposed expenditures include equipment, supplies and services that help support the City's law enforcement operations. The items requested this year include the purchase of five marked patrol vehicles and two motorcycles. Other costs include support for the Community Services Bureau, tactical equipment, undercover funds and other miscellaneous items (Attachment 1) for a total of $776,682. 33 -1
