City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: December 13, 2011 <br />FROM: CITY ATTORNEY AND CITY CLERK ITEM NO: <br />WARD:ALL <br />SUBJECT: PROPOSED CLARIFICATION TO THE CITY’S CODE OF ETHICS AND <br />CONDUCT FOR ELECTED OFFICIALS AND MEMBERS OF APPOINTED <br />BOARDS, COMMISSIONS AND COMMITTEES – RESOLUTION <br />ISSUE <br />The issue presented for consideration by the City Council is whether to adopt a revision to the <br />City’s Code of Ethics and Conduct to clarify the City Council’s scope of review on appeal. <br />COMMITTEE RECOMMENDATION: <br />That the City Council adopt the attached resolution clarifying the City Council’s scope of review <br />on appeal consistent with the City Council’s prior direction. <br />BACKGROUND <br />On September 20, 2011, the City Council conducted a public hearing in connection with its <br />annual review of the City’s Code of Ethics and Conduct as set forth in Resolution No. 22149. <br />Following discussion, the City Council approved the Governmental Affairs Committee’s <br />recommendations that the Code of Ethics and Conduct guide reflect that additional resources are <br />available from the California Attorney General, the California Fair Political Practices Commission, <br />and the Institute for Local Government via their websites. The City Council also directed that the <br />board and commission application include an advisement that if appointed and subsequently <br />elected chair of their respective board or commission, that they be called upon to serve as a <br />member of the adjudicating body. Finally, the City Council referred the appeal procedures to its <br />Governmental Affairs Committee. More specifically, the Mayor and City Council discussed <br />clarifying the Code of Ethics and Conduct to specifically address the scope of the City Council’s <br />review on appeal. <br />On December 7, 2011, with all members present, the Governmental Affairs Committee <br />unanimously recommended that the City Council adopt the attached resolution. <br />
