^ ��^"�:t�lt"��: <br />e� ,f�t�� , City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: November 1, 2011 <br />FROM: HUMAN RESOURCES DEPARTMENT ITEM NO: 26 <br />WARD: ALL <br />SUBJECT: ADOPTION OF ORDINANCE TO AMEND THE CALPERS CONTRACT FOR <br />LOCAL MISCELLANEOUS MEMBERS AND RESOLUTION TO AMEND THE <br />MASTER FRINGE BENEFITS AND SALARY RESOLUTION <br />ISSUE: <br />The issue for City Council's consideration is whether to adopt an ordinance to revise the local <br />miscellaneous CaIPERS Contract to provide a different level of benefits and a resolution amending <br />the master Fringe Benefits and Salary Resolution. <br />RECOMMENDATIONS <br />That the City Council: <br />Adopt the attached Ordinance to amend the local miscellaneous CaIPERS contract to <br />provide a different level of benefit; and <br />2. Adopt the attached Resolution amending the master Fringe Benefits and Salary <br />Resolution. <br />BACKGROUND <br />On September 20, 2011 the City Council began the process of enacting changes to the City's <br />contract with CaIPERS for local miscellaneous members by adopting a Resolution of Intention. The <br />City Council is now asked to adopt an Ordinance to formalize the contract amendment. This <br />process is consistent with Government Code 20471 that requires a minimum 20 day waiting period <br />between the adoption of the Resolution of Intention and the adoption of the final Ordinance. The <br />contract amendment will change the way final compensation is calculated to the average of the <br />three highest years rather than the single highest year. The proposed different level of benefit will <br />affect all local miscellaneous members including non - represented management, executive and <br />confidential employees, members of SEIU, IBEW and elected officials, entering CaIPERS <br />membership for the first time following the effective date of the contract amendment. The effective <br />date of this contract amendment will be December 9, 2011, which is the beginning of the first <br />eligible pay period. <br />26 -1 <br />
