CW4N Of <br />RJISI~D <br />City Council Memorandum <br />City 0"Ar•ts & Innovation <br />' wuuuuuwuuuuuuwuuuuuuuuuwuuuuuwumwuuuuuwuu mmuu uwuuuuuwuuuuuuwuouuuuuwu...... um mmmuuwu mmu wmmmuwuummuwummwuuuuuwuu...... uuuwuuuuuwuuuu <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: November 1, 2011 <br />FROM: PUBLIC WORKS DEPARTMENT ITEM NO: 15 <br />WARDS: ALL <br />SUBJECT: WESTERN RIVERSIDE COUNTY TRANSPORTATION UNIFORM MITIGATION <br />FEE — ORDINANCE TO EXTEND THE TEMPORARY TUMF REDUCTION; <br />RESOLUTION ADOPTING REVISED TUMF SCHEDULE AND TEMPORARY <br />TUMF REDUCTION <br />ISSUES <br />The issues for City Council consideration are: 1) approval of a 50% Transportation Uniform <br />Mitigation Fee (TUMF) reduction through December 2012 or until the program losses reach $20 <br />million whichever comes first; and 2) introduction and adoption of the appropriate Ordinance and <br />Resolution to implement a reduced fee. <br />RECOMMENDATIONS <br />That the City Council: <br />Approve a fee reduction of 50% through December 31, 2012, or until notification from <br />WRCOG that the program losses exceed $20 million and the fee reverts to 100 %; and <br />2. Introduce and adopt the attached Ordinance and Resolution. <br />BACKGROUND <br />In late 2009, the Western Riverside Council of Governments ( WRCOG) Executive Committee <br />authorized jurisdictions to temporally reduce the TUMF by 50% through December 2010 as a <br />strategy to possibility improve economic conditions in the region. The City Council adopted the <br />50% TUMF reduction on January 26, 2010. Ultimately, 10 of the 17 jurisdictions participating in <br />the TUMF program adopted the 50% fee reduction for 2010. <br />On December 6, 2010, the WRCOG Executive Committee approved returning the TUMF <br />program to full fee, but allowing individual jurisdictions to reduce the fee by either 25% or 50% <br />through December 2011. Only five (5) jurisdictions are participating in 2011; the County of <br />Riverside and the cities of Riverside, Perris, Norco and Eastvale, although Norco went back to <br />the full fee on April 14, 2011. <br />On October 3, 2011, the WRCOG Executive Committee approved extending the 25% or 50% <br />fee reduction through December 2012, provided the lost revenue to the TUMF program does not <br />exceed $20 million for the combined years of 2010 through 2012. If the revenue losses exceed <br />$20 million, the TUMF would revert to 100% for all jurisdictions. See Attachment 1 for the <br />15 -1 <br />
