RESOLUTION NO. <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Cm ?.TTnrNE1'5 OFFICE <br />59001\1 -anv STEEHT <br />RA'ERSIDE ' CA ?522 <br />(951) 526 -5567 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, <br />CALIFORNIA, DECLARING ITS INTENTION TO LEVY AN ANNUAL <br />ASSESSMENT IN THE DOWNTOWN PARKING AND BUSINESS <br />IMPROVEMENT AREA FOR CALENDAR YEAR 2012 PURSUANT TO <br />SECTION 36534 OF THE CALIFORNIA STREETS AND HIGHWAYS <br />CODE, GENERALLY DESCRIBING THE IMPROVEMENTS AND <br />ACTIVITIES TO BE UNDERTAKEN AND FIXING THE TIME AND <br />PLACE FOR A PUBLIC HEARING BEFORE THE CITY COUNCIL OF <br />THE CITY OF RIVERSIDE ON THE LEVY OF THE PROPOSED <br />ASSESSMENT. <br />WHEREAS, the City Council of the City of Riverside has received and approved the <br />report of the Riverside Downtown Partnership, acting as the Advisory Board of the Downtown <br />Parking and Business Improvement Area, as submitted on October 25, 2011 ( "Report ") <br />NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of Riverside, <br />California, pursuant to Section 36534 of the Streets & Highways Code as follows: <br />1. It is the intention of the City Council to levy and collect an annual assessment <br />within the Downtown Parking and Business Improvement Area ( "Area ") for the calendar year <br />beginning January 1, 2012, at a rate not to exceed the current rate of 100% of the business tax to <br />be paid by each business within the Downtown Parking and Business Improvement Area. <br />2. The Area was established by Ordinance No. 5303 to (a) engage in seasonal retail <br />promotions, (b) beautification and parking projects, and (c) general promotion of business <br />activities, all of which provide specific benefits directly to the businesses within the Area at a <br />cost which does not exceed the reasonable cost in conferring the benefit. <br />3. The Area is located in the downtown business area of the City of Riverside, and is <br />described as generally between First Street on the north, the 14th Street on the south, past the <br />Riverside /91 Freeway to the railroad tracks on the east, and the first tier of lots on the west side <br />of Brockton Avenue on the west, except that between Ninth Street and Sixth Street the easterly <br />boundary shall be the Riverside Water Company Canal, and also includes both sides of Market <br />Street from First Street to the 60 Freeway. The Area was approved for expansion by Resolution <br />No. 20054, on December 4, 2001, and by Resolution No. 21076, on November 22, 2005, and is <br />more fully described in the legal description and plat titled `Business Improvement District' <br />which is on file in the office of the City Clerk. <br />17 -3 1 <br />
