RESOLUTION NO. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Cm ?.TTnrNE1'5 OFFICE 59001\1 -anv STEEHT RA'ERSIDE ' CA ?522 (951) 526 -5567 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, CALIFORNIA, DECLARING ITS INTENTION TO LEVY AN ANNUAL ASSESSMENT IN THE DOWNTOWN PARKING AND BUSINESS IMPROVEMENT AREA FOR CALENDAR YEAR 2012 PURSUANT TO SECTION 36534 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE, GENERALLY DESCRIBING THE IMPROVEMENTS AND ACTIVITIES TO BE UNDERTAKEN AND FIXING THE TIME AND PLACE FOR A PUBLIC HEARING BEFORE THE CITY COUNCIL OF THE CITY OF RIVERSIDE ON THE LEVY OF THE PROPOSED ASSESSMENT. WHEREAS, the City Council of the City of Riverside has received and approved the report of the Riverside Downtown Partnership, acting as the Advisory Board of the Downtown Parking and Business Improvement Area, as submitted on October 25, 2011 ( "Report ") NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of Riverside, California, pursuant to Section 36534 of the Streets & Highways Code as follows: 1. It is the intention of the City Council to levy and collect an annual assessment within the Downtown Parking and Business Improvement Area ( "Area ") for the calendar year beginning January 1, 2012, at a rate not to exceed the current rate of 100% of the business tax to be paid by each business within the Downtown Parking and Business Improvement Area. 2. The Area was established by Ordinance No. 5303 to (a) engage in seasonal retail promotions, (b) beautification and parking projects, and (c) general promotion of business activities, all of which provide specific benefits directly to the businesses within the Area at a cost which does not exceed the reasonable cost in conferring the benefit. 3. The Area is located in the downtown business area of the City of Riverside, and is described as generally between First Street on the north, the 14th Street on the south, past the Riverside /91 Freeway to the railroad tracks on the east, and the first tier of lots on the west side of Brockton Avenue on the west, except that between Ninth Street and Sixth Street the easterly boundary shall be the Riverside Water Company Canal, and also includes both sides of Market Street from First Street to the 60 Freeway. The Area was approved for expansion by Resolution No. 20054, on December 4, 2001, and by Resolution No. 21076, on November 22, 2005, and is more fully described in the legal description and plat titled `Business Improvement District' which is on file in the office of the City Clerk. 17 -3 1
