<br />SUBJECT: INTENTION TO LEVY ANNUAL ASSESSMENT IN THE RIVERSIDE
<br />DOWNTOWN PARKING AND BUSINESS IMPROVEMENT AREA (RDPBIA) -
<br />RESOLUTION ADOPTION
<br />ISSUE
<br />The RDPBIA requires an annual process to levy the additional assessment fees the business
<br />owners imposed upon themselves. A resolution must be adopted stating the City's intention to levy
<br />those fees for the 2012 calendar year and set a public hearing for November 15, 2011, to receive
<br />comments from interested parties.
<br />RECOMMENDATIONS
<br />That the City Council:
<br />1. Receive and approve the annual report of the RDPBIA.
<br />2. Adopt a Resolution of Intention to impose the annual levy for calendar year 2012.
<br />3. Schedule a public hearing for November 15, 2011, at 3:00 PM for the purpose of adopting a
<br />resolution setting the 2012 RDPBIA levy.
<br />BACKGROUND
<br />In 1985, in conjunction with the Riverside Downtown Partnership ( "RDP "), the Riverside Downtown
<br />Parking and Business Improvement Area ( "RDPBIA ") was formed. Each year the Advisory Board of
<br />the RDPBIA is required to present its annual report to the City Council. A copy is attached.
<br />The RDP, which acts as the Advisory Board of the RDPBIA, is partially funded by a levy equal to
<br />100% of the Business Tax of businesses within the Area boundaries. The levy provides funding for
<br />specific benefits that are conferred directly to the businesses within the RDPBIA, which does not
<br />exceed the reasonable costs to the City for conferring the benefits. For the levy to continue for
<br />2012, the City Council must adopt a Resolution of Intention to impose the levy for the calendar year
<br />and set a public hearing. The public hearing is being set for November 15, 2011, at 3:00 PM in the
<br />Council chambers at City Hall, at which time protests may be heard against the proposed action.
