The pedestrian walkway is <br />located between 6362 and 6368 San Diego Avenue, on the easterly side of the street between <br />Central Avenue and Nelson Street. <br />RECOMMENDATIONS <br />That the City Council: <br />Approve Planning Case P11 -0351 to summarily vacate the approximately 660 square <br />feet of excess public right -of -way (currently improved as a pedestrian walkway) and <br />authorize the preparation of a Certificate of Compliance to incorporate the vacated area <br />into the property at 6362 San Diego Avenue; <br />2. Adopt the attached Summary Vacation Resolution (Exhibit 5); and <br />3. Authorize the City Manager, or his designee, to execute quitclaim deeds as necessary. <br />BACKGROUND <br />This proposal is a request to summarily vacate an approximately five -foot wide by 132 -foot <br />long pedestrian walkway. The summary vacation is needed given that the pedestrian walkway <br />extends only to the rear property line of the subject lots at 6362 and 6368 San Diego Avenue, <br />and is technically a dead -end walkway that does not serve as a connection to any other right - <br />of -way areas. This situation exists because the lots immediately to the east of the area to be <br />vacated, addressed 6359 and 6363 Coby Court, do not include an extension of this walkway <br />along their shared interior property lines. Instead, a drainage ditch within a five -foot wide utility <br />easement exists between the two properties on Coby Court (Exhibit 4). Currently, residents of <br />the area use both the existing walkway and the unimproved storm drain easement to walk <br />between San Diego Avenue and Coby Court as a shortcut to access commercial uses in close <br />proximity to the neighborhood. Residents of the area have reported that loitering and other <br />suspicious activities occur in the subject area. As an example, the residents have had to <br />23 -1 <br />
