Cit 4 1 : 41 11 1 . 5 City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: DEVELOPMENT DEPARTMENT <br />DATE: August 9, 2011 <br />ITEM NO: 27 <br />WARD: 3 <br />SUBJECT: RELOCATION PLAN FOR THE RIVERSIDE AVENUE GRADE SEPARATION <br />PROJECT <br />ISSUE <br />The issue before the City Council is whether to adopt the attached Relocation Plan (Exhibit A) for <br />the Riverside Avenue Grade Separation Project (Project). <br />RECOMMENDATION <br />That the City Council adopt the Relocation Plan for the Project. <br />BACKGROUND <br />The City Council approved the Project on May 12, 2009 and appropriated funding on April 26, 2011. <br />The Riverside Avenue Grade Separation at the Union Pacific Railroad (UPRR) project will construct <br />a new grade separation (underpass) along Riverside Avenue from Merrill Avenue to approximately <br />300 feet north of Elizabeth Street by constructing a two -track railroad bridge. With the change in <br />profile of Riverside Avenue, the existing Tipperary Way and Elizabeth Street connections to <br />Riverside Avenue will be eliminated and will be terminated in a cul -de -sac at Riverside Avenue. A <br />new street will be constructed to connect Tipperary Way and Trinity Court to Riverside Avenue via <br />Sunnyside Drive. <br />The Project will require the full acquisition of ten (10) parcels and the partial acquisition of <br />permanent and /or temporary easements on seven (7) parcels. Of these parcels, three (3) owner <br />occupants, five (5) residential tenants, and eight (8) commercial tenants on two (2) parcels <br />(displacees) may have relocation requirements and are included in the Plan. Revisions to the <br />design of the project may eliminate the need to relocate one (1) owner - occupant and two (2) <br />residential tenants; however, they are currently included in the Relocation Plan for consistency with <br />the original design. <br />Pursuant to statutes and regulations established by the Uniform Relocation Assistance and Real <br />Property Acquisition Policies Act of 1970, as amended (URA), 49 CFR Part 24, and California Code <br />of Regulations at Title 25, Division 1, Chapter 6, the City, through its consultant, Paragon Partners <br />Ltd. (Paragon), prepared a Relocation Plan to address the displacements caused by the Project. <br />27 -1 <br />
