City Council Memorandum TO: HONORABLE MAYOR AND CITY COUNCILDATE: August 9, 2011 FROM: CITY ATTORNEY ITEM NO: WARD: ALL SUBJECT: REIMBURSEMENT OF ATTORNEY’S FEES AND COSTS ASSOCIATED WITH THE ADMINISTRATIVE CODE ENFORCEMENT ACTION AND REHABILITATION OF THE PROPERTY AT 8744 MESA OAK DRIVE – SUPPLEMENTAL APPROPRIATION ISSUE: The issue presented for consideration by the City Council is whether to accept reimbursement for fees and costs expended by the City Attorney’s Office in connection with the administrative code enforcement action and rehabilitation of the property located at 8744 Mesa Oak Drive. RECOMMENDATIONS: That the City Council: 1. Approve the acceptance of $3,000.00 for attorney’s fees and costs associated with the code enforcement action and rehabilitation of the property at 8744 Mesa Oak Drive; and 2. Increase revenues and appropriate expenditures in the amount of $3,000.00 to Special Program Account Number 1300000-450209. BACKGROUND: The property at 8744 Mesa Oak Drive (Ward 4) has been the subject of an administrative code enforcement action for landscape and exterior maintenance violations. The City of Riverside has been able to successfully negotiate a rehabilitation agreement with the property owner. In exchange for the payment of $10,000.00 in administrative civil penalties and $3,000.00 in attorney’s fees, the property owner has agreed to correct all violations and maintain the property in compliance with Chapters 6.11 and 6.14 of the Riverside Municipal Code.
