1 ORDINANCE NO. 6480 <br /> <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, EXTENDING THE <br /> INTERIM ZONING MEASURE ESTABLISHED BY ORDINANCE NO. 64?4 <br /> 3 ESTABLISHING A MORATORIUM ON THE ACCEPTANCE OF APPLICATIONS <br /> FOR AUTOMOBILE GARAGE, PUBLIC OR PRIVATE, INCLUDING INCIDENTAL <br /> 4 AUTOMOBILE PAINTING, AND BODY AND FENDER WORK FOR THOSE <br /> PROPERTIES LOCATED IN THE C-3 (GENERAL COMMERCIAL) ZONE AND <br /> 5 LOCATED ALONG THE SCENIC BOULEVARDS AS DESIGNATED IN THE <br /> GENERAL PLAN WITHIN THE CITY OF RIVERSIDE FOR A PERIOD OF 10 <br /> 6 MONTHS AND 15 DAYS PURSUANT TO GOVERNMENT CODE SECTION 65858 <br /> TO PROTECT THE PUBLIC HEALTH, SAFETY AND WELFARE; AND <br /> 7 DECLARING THIS ORDINANCE TO BE AN URGENCY MEASURE. <br /> <br />8 WHEREAS, the Planning Department of the City of Riverside is studying the zoning <br />9 regulations of the City relating to the siting and operation of automobile repair garage uses in the <br />10 General Commercial (C~3) Zone along designated Scenic Boulevards as well as throughout the City <br />11 and whether such uses should be permitted only with a conditional use permit rather than as a matter <br />12 of right in certain zones; and <br />13 WHEREAS, the study has not yet been completed; and <br />14 WHEREAS, the City Council of the City of Riverside found that the expansion of or <br />15 establishment of new automobile repair garages, including automobile painting and body and fender <br />16 work, in the C-3 Zone on Scenic Boulevards as designated on the Transportation Element of the <br />17 General Plan, without appropriate development standards or the requirement of a conditional use <br />18 permit is a current and immediate threat to the public health, safety and welfare based on significant <br />19 negative compatibility problems such as heavy automobile traffic and negative aesthetic impacts <br />20 often associated with garages on the sensitive street frontages which exist along the General Plan' s <br />21 designated Scenic Boulevards; and <br />22 WHEREAS, on June 1, 1999, the City Council adopted Ordinance No. 6474 establishing <br />23 as an interim zoning measure, a temporary moratorium of the acceptance of applications for <br />24 automobile garages, public or private, including incidental automobile painting, and body and <br />25 fender work for those properties located in the C-3 Zone and located along the Scenic Boulevards as <br />26 designated in the General Plan within the City of Riverside for a period of 45 days pursuant to <br />27 Section 65858 of the Government Code of the State of California, which interim zoning measure <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(909) 782-5567 <br /> <br /> <br />
