I RESOLUTION NO. 22069 <br /> 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> RIVERSIDE, CALIFORNIA, ORDERING, CALLING, PROVIDING <br /> 3 FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION <br /> TO BE HELD IN SAID CITY ON THE 2nd DAY OF NOVEMBER, <br /> 4 2010 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED <br /> ELECTORS OF THE CITY OF RIVERSIDE, AN AMENDMENT TO <br /> 5 CHAPTER 5.32 OF THE RIVERSIDE MUNICIPAL CODE TO <br /> INCREASE THE CITY'S TRANSIENT OCCUPANCY TAX FROM <br /> 6 ELEVEN PERCENT (11 %) TO TWELVE PERCENT (12 %, <br /> EFFECTIVE JULY 1, 2012, AND TO THIRTEEN PERCENT (13 %) <br /> 7 EFFECTIVE JULY 1, 2014, AND GIVING NOTICE AND ORDERING <br /> THAT SAID SPECIAL MUNICIPAL ELECTION BE CONSOLIDATED <br /> 8 WITH ALL OTHER ELECTIONS BEING HELD IN THE SAME <br /> TERRITORY ON THE SAME DATE. <br /> 9 <br /> 10 <br /> 11 WHEREAS, the City of Riverside has an existing transient occupancy tax ordinance <br /> 12 which is set forth in Chapter 5.32 of the Riverside Municipal Code and which was initially <br /> 13 adopted by the City in 1966, and which provides for a tax to be imposed on the privilege of <br /> 14 occupying rooms within hotels, motels, inns and other dwelling units within the City for periods <br /> 15 of less than thirty days; and <br /> 16 WHEREAS, the City's transient occupancy tax is considered a general tax under Article <br /> 17 XHIC of the California Constitution; and <br /> 18 WHEREAS, the existing transient occupancy tax rate set forth in Chapter 5.32 has not <br /> 19 been increased since 1993; and <br /> 20 WHEREAS, the City's existing transient occupancy rate of eleven percent (11 %) is less <br /> 21 than certain other similarly situated cities with convention centers such as Ontario and Palm <br /> 22 Springs; and <br /> 23 WHEREAS, the City Council now desires to provide for an increase of the transient <br /> 24 occupancy tax rate, by increasing the tax rate from eleven percent (11 %) to twelve percent <br /> 25 (12 %), effective July 1, 2012, and from twelve percent (12 %) to thirteen percent (13 %), effective <br /> 26 July 1, 2014; and <br /> 27 WHEREAS, Article XIIIC of the California Constitution requires that any proposed <br /> 28 increase in a general tax must be submitted to, and approved by, a majority of those qualified <br /> 1- <br />
