ATTORNEY'S OFFICE <br />3900 M 'IN IT F.:.. <br />RP,ERSIDE, CA 92522 <br />(951) 826-5567 <br />RESOLUTION NO. 914 <br />A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF <br />RIVERSIDE, CALIFORNIA, (1) DECLARING THAT THE FIRE DAMAGE <br />REPAIR AT SIMPLE SIMON'S BAKERY & BISTRO LOCATED AT 3639 MAIN <br />STREET IS OF URGENT NECESSITY FOR THE PRESERVATION OF LIFE, <br />HEALTH AND PROPERTY; (2) AUTHORIZING THE WORK TO BE <br />PERFORMED WITHOUT COMPETITIVE BIDDING PURSUANT TO PUBLIC <br />CONTRACT CODE SECTION 22050 (3) AWARDING A CONTRACT TO <br />AMERICAN TECHNOLOGIES, INC. FOR THE NECESSARY WORK; AND (4) <br />AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE THE <br />NECESSARY CONTRACT DOCUMENTS. <br />WHEREAS, in August, 2009, the Redevelopment Agency of the City of Riverside <br />("Agency") acquired the Freeman, Spriggs & Was building ("Property") abutted by Market Street, <br />Main Street and Sixth Street in the City of Riverside; and <br />WHEREAS, the Property included the premise at 3639 Main Street leased by Simple <br />Simon's Bakery & Bistro ("Premise"); and <br />WHEREAS, the Agency purchased the Property subject to its existing leases; and <br />WHEREAS, on February 12, 2010, the Premise was damaged by a fire ignited by the <br />spontaneous combustion of grease laden cloths; and <br />WHEREAS, the fire damage left the Premise potentially structurally unsound and exposed to <br />the elements; and <br />WHEREAS, the Agency is obligated under the terms of the lease agreement with Simple <br />Simon's Bakery & Bistro to repair the fire damage within 120 days of the date of the fire; and <br />WHEREAS, repair of the fire damage at the Premise is of urgent necessity for the <br />preservation of life, health and property given the state of the Premise; and <br />WHEREAS, agency staff undertook an informal competitive bidding process and obtained <br />four (4) bids for the fire damage repair work; and <br />WHEREAS, the lowest responsive and responsible bidder under the informal competitive bid <br />process is American Technologies, Inc., with a bid of $199,952.65; and <br />WHEREAS, due to the unknown extent of latent damage to the Premise, it is highly likely <br />that additional change order work may be required after the demolition and destruction work is <br />completed; and <br />
