Yamamoto, City Attorney <br /> <br />SUBJECT: <br /> <br />Closed Session - Existing Litigation <br />Name of Case: <br />The Cities of Anaheim and Riverside, California vs. Deseret <br />Generation & Transmission Cooperative; Federal Energy <br />Regulatory Commission Docket No. EL97-57-000 <br /> <br />[Govemment Code §54956. 9] <br /> <br />A closed session will be held on June 1, 1999, for the purpose of conferring with and/or <br />receiving advice from your legal counsel concerning litigation which has been formally <br />initiated to which the City of Riverside is a party. [Gov't. Code §54956.9(a)] <br /> <br />The City Attorney will provide you with a status report on this particular case. <br /> <br />If the City Council authorizes the City Attorney to defend, or seek or refrain from seeking <br />appellate review or relief, this determination shall be disclosed immediately following this <br />closed session. If the City Council authorizes initiation or intervention, such authorization <br />shall be disclosed immediately following this closed session and the public advised that the <br />action, defendants and other particulars will be disclosed upon request after the action is <br />formally commenced, unless to do so would jeopardize the City's ability to effectuate <br />service of process on one or more unserved parties, or to do so would jeopardize the City's <br />ability to conclude existing settlement negotiations to its advantage. [Gov't. Code <br />§54957. 1 (a)(2)] <br /> <br />If the City Council accepts a settlement offer signed by the opposing party, the substance <br />of the settlement and its acceptance shall be disclosed immediately following this closed <br />session. [Gov't.
