PLANNING COMMISSION <br />RECOMMENDED CONDITIONS <br />Case No.: P09-0160 PLANNING COMMISSION HEARING DATE: June 4, 2009 <br />CONDITIONS <br />The applicant is advised that the business or use for which this conditional use permit is granted <br />cannot be legally conducted on the subject property until all conditions of approval have been met to <br />the approval of the Community Development Department, Planning Division. <br />Case Specific <br />• Planning <br />1. The Planning Commission makes the necessary findings in the applicant's favor to grant <br />the following variances. The applicant's justifications and staff s supplemental variance <br />justifications are referenced: <br />Variance A: To allow a minimum site area of approximately 0.49 acres for the <br />proposed vehicle repair facility, where the Zoning Code requires a minimum site area <br />of 0.5 acres for vehicle repair facilities; <br />Variance B: To allow direct access to the vehicle repair facility site from Doolittle <br />Avenue, an 80-foot wide local street, where the Zoning Code requires direct access <br />from an arterial or collector street as designated on the General Plan Master Plan of <br />Roadways. <br />2. The vehicle repair facility shall be operated as described in the submitted application for <br />this case, as described in the body of the attached report and in compliance with Section <br />19.420 of the Zoning Code. <br />3. Construction and operation activities on the property shall be subject to the City's Noise <br />Code (Title 7), which limits construction noise to 7:00 a.m. to 7:00 p.m. weekdays, and <br />8:00 a.m. to 5:00 p.m. Saturdays. No construction noise is permitted on Sundays or <br />federal holidays. <br />4. The project shall comply with all existing State Water Quality Control Board and City <br />storm water regulations, including compliance with NPDES requirements related to <br />construction and operation measures to prevent erosion, siltation, transport of urban <br />pollutants, and flooding. <br />5. Construction and operation of the facility shall be in compliance with the adopted <br />Riverside County Airport Land Use Compatibility Plan, including, but not limited to, <br />dedication of an avigation easement, recording of a deed notice and completion of a <br />disclosure statement upon the transfer of real estate. <br />Prior to Occupancy: <br />6.
