• City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: July 14, 2009 <br />FROM: DEVELOPMENT DEPARTMENT ITEM NO: 41 <br />WARD: 5 <br />SUBJECT: PROPOSED PURCHASE AND SALE AGREEMENT WITH RICKY MARES, <br />SUCCESSOR TRUSTEE OF THE TESORO AND FRANCISCA ALVAREZ <br />FAMILY TRUST DATED SEPTEMBER 22, 2000 FOR THE ACQUISITION OF A <br />TWO-THIRD INTEREST IN 9568 INDIANA AVENUE FOR THE STATE ROUTE <br />91/VAN BUREN BOULEVARD INTERCHANGE IMPROVEMENT PROJECT <br />ISSUE <br />The issue before the City Council is whether to approve the attached Purchase and Sale <br />Agreement (Agreement - Exhibit "A") with Ricky Mares, Successor Trustee of the Tesoro and <br />Francisca Alvarez Family Trust dated September 22, 2000 ("Alvarez-Mares") to acquire two-thirds <br />(2/3rds) interest in the property located at 9568 Indiana Avenue, being Assessor Parcel Number <br />(APN) 234-250-013, for $290,000, plus $25,000 for relocation, title, escrow, and related costs for <br />a total cost of $315,000. <br />RECOMMENDATIONS <br />That the City Council: <br />1. Approve the Agreement for the purchase of a 2/3rds interest in 9568 Indiana Avenue, APN <br />235-250-013, for $290,000. <br />2. Authorize the City Manager, or his designee, to execute the Agreement, including making <br />minor, non-substantive changes, and to sign all documents and instruments necessary to <br />complete this transaction, and to expend up to $25,000 for relocation, title, escrow, and <br />related miscellaneous costs, for a total of $315,000. <br />BACKGROUND <br />The City of Riverside (City), in cooperation with the Riverside County Transportation Commission <br />(RCTC), and the California Department of Transportation District 8 (Caltrans), proposes to <br />improve the interchange at State Route 91 (SR-91) and Van Buren Boulevard (Project). On April <br />11, 1995, the City and RCTC entered into a Memorandum of Understanding for the Funding of <br />SR-91/Van Buren Boulevard Interchange Improvement Project. The proposed Project will <br />provide ramp improvements, including an eastbound SR-91 hook on-ramp from Indiana Avenue, <br />west of Van Buren Boulevard, and a new SR-91/Van Buren Boulevard overcrossing (widened <br />from four to six through lanes plus dedicated turn lanes) that will accommodate the ultimate SR- <br />91 10-lane facility. The estimated construction cost of $35 million will be funded by Riverside <br />County Measure "A", Transportation Uniform Mitigation Fee (TUMF), State Transportation <br />Improvement Program (STIP), Federal Surface Transportation Program - Local (STPL), and <br />Congestion Mitigation and Air Quality (CMAQ) funds. <br />Companion improvements will result in Van Buren Boulevard being widened from the intersection <br />of the westbound ramps in the northerly direction to Primrose Street to match the newly <br />completed Van Buren Boulevard widening from Primrose Street to Magnolia Avenue.
