TO: HONORABLE MAYOR AND CITY COUNCIL FROM: PUBLIC WORKS DEPARTMENT DATE: July 14, 2009 ITEM NO: 54 WARDS: ALL SUBJECT: CITY GRANITE PIT-FINANCIAL ASSURANCE MECHANISM REQUIRED BY CALIFORNIA SURFACE MINING AND RECLAMATION ACT OF 1975 ISSUE: The issue for City Council consideration is adoption of a resolution to adjust the Financial Assurance Amount required by the Surface Mining and Reclamation Act of 1975 (California Public Resources Code) for the surface mining activities conducted at the City Granite Pit (approximately 13.5 acres) located at Fremont Street and Mountain View Avenue in Riverside, California. RECOMMENDATION That the City Council adopt the attached resolution formally reserving funds required to reclaim the City-owned mining operation in accordance with California Public Resources Code section 2710 and repeal Resolution No. 18978. BACKGROUND The California Surface Mining and Reclamation Act of 1975 (California Public Resources Code sections 2710 et. seq.) requires financial assurances of each surface mining operation to ensure that reclamation is performed in accordance with the surface mining operation's approved reclamation plan. The purpose of the reclamation plan is to ensure that the mined land is restored to a condition suitable for other land uses. The City of Riverside owns and operates a surface mining operation at the City Granite Pit located at Fremont Street and Mountain View Avenue in Riverside, California. The facility is used by the Public Works Street Division. The Street Division mines decomposed granite, backfills the facility, and uses the area for temporary materials storage. On September 17, 1996, the City Council approved Resolution No. 18978. The resolution established a budget set aside as the financial assurance mechanism required by the Surface Mining and Reclamation Act of 1975 for surface mining operations in the amount of $169,279. The amount is subject to annual review and change pursuant to the Act. The City of Riverside was recently notified by the State Department of Conservation Office of Mine Reclamation that the state has reviewed the financial assurance amount and has increased said amount from $169,279 to $184,738.
