1 City Council Memorandum <br />. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . <br />. . . . . . <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: PUBLIC WORKS DEPARTMENT <br />DATE: July 14, 2009 <br />ITEM NO: 54 <br />WARDS: ALL <br />SUBJECT: CITY GRANITE PIT-FINANCIAL ASSURANCE MECHANISM REQUIRED BY <br />CALIFORNIA SURFACE MINING AND RECLAMATION ACT OF 1975 <br />ISSUE: <br />The issue for City Council consideration is adoption of a resolution to adjust the Financial <br />Assurance Amount required by the Surface Mining and Reclamation Act of 1975 (California Public <br />Resources Code) for the surface mining activities conducted at the City Granite Pit (approximately <br />13.5 acres) located at Fremont Street and Mountain View Avenue in Riverside, California. <br />RECOMMENDATION <br />That the City Council adopt the attached resolution formally reserving funds required to reclaim the <br />City-owned mining operation in accordance with California Public Resources Code section 2710 <br />and repeal Resolution No. 18978. <br />BACKGROUND <br />The California Surface Mining and Reclamation Act of 1975 (California Public Resources Code <br />sections 2710 et. seq.) requires financial assurances of each surface mining operation to ensure <br />that reclamation is performed in accordance with the surface mining operation's approved <br />reclamation plan. The purpose of the reclamation plan is to ensure that the mined land is restored <br />to a condition suitable for other land uses. <br />The City of Riverside owns and operates a surface mining operation at the City Granite Pit located <br />at Fremont Street and Mountain View Avenue in Riverside, California. The facility is used by the <br />Public Works Street Division. The Street Division mines decomposed granite, backfills the facility, <br />and uses the area for temporary materials storage. <br />On September 17, 1996, the City Council approved Resolution No. 18978. The resolution <br />established a budget set aside as the financial assurance mechanism required by the Surface <br />Mining and Reclamation Act of 1975 for surface mining operations in the amount of $169,279. The <br />amount is subject to annual review and change pursuant to the Act. <br />The City of Riverside was recently notified by the State Department of Conservation Office of Mine <br />Reclamation that the state has reviewed the financial assurance amount and has increased said <br />amount from $169,279 to $184,738.
