1 City Council Memorandum <br />. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . <br />. . . . . . <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: PUBLIC WORKS DEPARTMENT <br />DATE: July 14, 2009 <br />ITEM NO: 56 <br />WARDS: 1 and 3 <br />SUBJECT: RIVERSIDE RENAISSANCE-INCREASE IN CHANGE ORDER AUTHORITY BID <br />NO. 6627, MAGNOLIA AVENUE UNDERPASS AT THE UNION PACIFIC <br />RAILROAD (UPRR) SEWER RELOCATION-JURUPA AVENUE FROM PALM <br />AVENUE TO MAGNOLIA AVENUE <br />ISSUE: <br />The issue for City Council consideration is an increase in change order authority for Bid No. 6627- <br />Magnolia Avenue Underpass at the Union Pacific Railroad (UPRR) Sewer Relocation-Jurupa <br />Avenue from Palm Avenue to Magnolia Avenue from $113,677.05 to $190,000 of the contract <br />amount due to unanticipated conditions encountered during construction and additions to the scope <br />of the project. <br />RECOMMENDATION: <br />That the City Council authorize an increase to the cumulative change order limitation from <br />$113,677.05 to $190,000 for Bid No. 6627, Magnolia Avenue Underpass at the UPRR Sewer <br />Relocation-Jurupa Avenue from Palm Avenue to Magnolia Avenue. <br />BACKGROUND: <br />On June 17, 2008, the City Council awarded a contract to J. Fletcher Creamer & Son, Inc. for the <br />Magnolia Avenue Underpass at the UPRR Sewer Relocation-Jurupa Avenue from Palm Avenue to <br />Magnolia Avenue project in the amount of $1,367,705.00. The project constructed a new sewer line <br />in Jurupa Avenue between Magnolia Avenue and Palm Avenue and reconfigured the sewer in <br />portions of Magnolia Avenue and Nogales Street to redirect sewer flows around the proposed <br />Magnolia Avenue Underpass project. The change order authority for the awarded contract was <br />limited to $113,677.05. The Public Works Department is requesting that this amount be increased <br />to $190,000 to address unforeseen conditions encountered during construction and additions to the <br />scope of the project. <br />The majority of the increase in change order authority associated with unforeseen work conditions <br />involves a gas line encountered during construction. The Gas Company identified a 6-inch gas line <br />as being located 7-feet south of the sewer trench. However, during construction the gas line was <br />actually found to be located 3-feet north of the sewer line and within the trench area. This condition <br />lasted for approximately 1,500-feet. The existing gas line required the contractor to change the type <br />of shoring at times and reduced the contractor's rate of production. The contractor and the Public <br />56-1 <br />
