Eel City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: July 14, 2009 <br />FROM: COMMUNITY DEVELOPMENT DEPARTMENT ITEM NO: 21 <br />PLANNING DIVISION <br />WARDS: ALL <br />SUBJECT: PLANNING CASE P09-0107 - ZONING CODE TEXT AMENDMENT <br />RELATED TO THE RECONSTRUCTION OF DESTROYED <br />NON-CONFORMING MULTIPLE FAMILY DWELLINGS <br />ISSUE: <br />This request is a proposal by the City of Riverside to amend the Zoning Code (Title 19 of <br />the Municipal Code) to create a process to allow non-conforming multiple-family structures <br />that have been destroyed by more than 50 percent to be restored through consideration of <br />a Minor Conditional Use Permit (MCUP) and compliance with current development <br />standards. <br />RECOMMENDATIONS: <br />That the City Council: <br />Determine the proposed project will not have a significant effect on the environment <br />based upon the findings set forth in the case record and adopt a Negative <br />Declaration; and <br />2. Approve Planning Case P09-0107 based on and subject to the Planning <br />Commission findings and recommended conditions found in the attached staff <br />report and introduce the attached ordinance. <br />STAFFIPLANNING COMMISSION RECOMMENDATIONS: <br />Staff recommended approval subject to the recommended conditions of approval. On May <br />7, 2009, the City Planning Commission recommended approval of Planning Case P09- <br />0107 by a vote of 5 ayes, 0 noes and 0 abstentions, subject to staff's recommended <br />conditions. <br />BACKGROUND: <br />On January 27, 2009, the City Council directed the Planning Division to initiate an <br />amendment to the Zoning Code to allow non-conforming multiple-family structures that <br />have been destroyed by more than 50 percent to be restored through consideration of a <br />Minor Conditional Use Permit (MCUP) and compliance with current development <br />21-1 <br />
