• City Council Memorandum <br />TO <br />FROM: <br />HONORABLE MAYOR AND CITY COUNCIL DATE: July 14, 2009 <br />CITY MANAGER - FINANCE ITEM NO: 18 <br />WARD: 7 <br />SUBJECT: <br />ISSUE: <br />PUBLIC HEARING - 2009/10 RIVERWALK LANDSCAPE MAINTENANCE <br />DISTRICT - RESOLUTION ADOPTION <br />The Council meeting of June 23, 2009 set a Public Hearing for July 14, 2009 to receive public <br />comment regarding the levy of annual assessments within the Riverwalk Landscape Maintenance <br />District. The Public Hearing is required by law to levy the assessments, as is adoption of the <br />attached resolution. This process occurs each fiscal year to allow for the levy of the assessments <br />on the properties within the District. <br />RECOMMENDATIONS: <br />That the City Council: <br />1. Conduct the Public Hearing for the purpose of receiving comments relative to the 2009/10 <br />Riverwalk Landscape Maintenance District assessments; and <br />2. Consider the adoption of a resolution establishing the 2009/10 Riverwalk Landscape <br />Maintenance District assessments. <br />BACKGROUND: <br />Today has been scheduled for a Public Hearing to discuss and adopt a resolution for the proposed <br />2009/10 assessments for the Riverwalk Landscape Maintenance District. The cost of maintaining <br />the landscaping and administration of the District will be assessed to the property owners within the <br />District. All parcels within the District have been assessed annually regardless of the status of their <br />development. <br />The Riverwalk Landscape Maintenance District was formed underthe provisions of the 1972 Street <br />Lighting and Landscaping Act. In July 2002, a property owner ballot, required by Proposition 218, <br />approved the formation of the District. The landscape improvements designed for the project are in <br />excess of normal City standards and the construction of the improvements has been funded by the <br />developer of the Riverwalk neighborhood. <br />18-1 <br />
